Manila, Philippines - The Sandiganbayan junked the motion of former Senator Jinggoy Estrada, asking for the dismissal of the 11 counts of graft charges filed against him in relation to the Php10Billion Pork Barrel Fund scam.
In a seven-page resolution, the anti-graft court 5th division denied Estrada’s motion due to lack of merit.
Based on the motion filed by Estrada, the former Senator insisted on the dismissal of his 11 counts of graft charges because the said accusations are already included in the plunder case filed against him at the same court.
However, the court explained that the information found in Estrada’s graft case are separate from the information inserted in his plunder case, therefore they cannot be considered as one and the same.
The Sandiganbayan insisted that though both the plunder and graft charges stemmed from the same accusation, under our existing laws, the two cases should be heard separately.
