SC affirms legality of EDCA

Manila, Philippines - The Supreme Court (SC), voting 9-4, upheld on Tuesday the constitutionality of the Enhanced Defense Cooperation Agreement (EDCA), which allows US military presence in the Philippines.

The High Court denied the motion for reconsideration filed by former Senators Rene Saguisag and Wigberto Tanada, and the Bagong Alyansang Makabayan and several party list groups. The motion alleged that the EDCA undermines Philippine sovereignty.

The Court noted that former President Benigno Aquino III, in ratifying the EDCA, was faithful in fulfilling his oath of office based on the 1987 Constitution; and that the existing Visiting Forces Agreement serves as the constitutional basis for the EDCA.

Saguisag and Tanada were among the the 12 Senator who voted for the removal of the US bases in the Philippines in 1992.
