The death of 44 SAF New heroes must be the death of BBL

 Today is the "National Mourning Day" set by his Excellency Benigno "PNoy" Aquino commemorating the bravest and heroic deaths of forty-four (44) members and Officers of the Philippine National Police - Special Action Force (PNP - SAF). We commemorate, condole and pray for the eternal peace of the souls of these young heroes of our generation and we pray for the acceptance and fast recovery on the part of the survivors and those of the aggrieved Families.

 In my area alone, 'though I can attest that they too are dissatisfied on PNoys statement on alleged 'miss-encounter operation' of the PNP-SAF, loud sounds of  almost all of the songs popularized by "Asin" especially the highly popularized "Cotabato" song portraying the bloody history fights that happened and is happening in this mountainous part of the Country, these types of songs are repeatedly played and are being played as of this writing and probably will be played 'til late afternoon today or 'til weekend probably, to honor the great contributions of these new Filipino Heroes whose death are heinous and brutally unacceptable. None dares to stop it as a respect for the Families, relatives and concern ones and probably to give way for the loneliness that most of us Filipinos are having for losing them.

I myself, upon hearing the news, I felt the intense loneliness and worrisome for the victims and for their individual families, more so that these young heroes had just started their Family lives and some are just about to. The first question that I had was about their Families who all are dependent and were left with huge pains left with hatred and anxieties for their love one's death. Another thing is about their financial survival, as seen and featured on TV.  These drove me read and remains focused on this issue, because I strongly believe that the more comments and articles we post on Social media, the higher chances we have for PNoy to recognize the needs of these Families (as accordingly, based on yesterday's post - The Palace strongly believed that majority were not dissatisfied on the President's  National Televised report about what happened in Mamasapano, two days ago) - the needs for answer, proper explanation, assurance and above all the justice for the heinous death of these young-highly trained heroes. And since they are considered Special and Highly-trained troops of PNP, it is right and just for the Families to get answers from the Government and that's what PNoy owed to them.

The Government has to double their action to cover and possibly  answer all of the Families questions as to: What really happened, Why it happened and Who did it to the victims? They also have to seek answer to allegations involving treachery of the rebel groups, hence the government is into a peace talk agreement. Some also are asking as to why there hasn't any back up plan and no immediate rescue happened during the almost eleven-hour of fighting. Also, hence admitted on National TV that the President has the knowledge of the mission - which they called 'Oplan Wolverine'. If so, knowing that Purisima is suspended, What did he do to secure the lives of these Police Officers/members of SAF? Why point the fingers to others when he should have also done his part being the highest ranking Official? Why do we sit back and relax for the suspension of SAF Commander when the President himself has the knowledge of the operation yet he did not do his part - for concerned Filipino citizen it isn't enough to just simply hear the President's word that the terrorist has a long time Warrant of Arrest and the SAF already know what to do, when in times of failure are being hit back for lack of planning and coordination? And for heavens sake, this is the question that most of us do not understand - - - Why do we have to seek permission and coordination to the Rebel group called MILF when: Number 1, the BBL is yet to finalize and is not established yet, therefore this group is currently not and should not be legally recognized by State in terms of National security. Second, Even the AFP and the rest of the must informed Government Branches and Officials weren't informed for the purpose of security and for successful capture of the terrorists, why do they have to inform them [MILF] first before doing the operation when they even over-passed the other legal government bodies? Third, granting that they were informed (which according to some reports, they were really informed, as negotiations happened on the battlefield) can we keep their words to not disclose the plan to BIFF,MWLF, ASG and the rest of the Government enemies? Can we secure the capture of these terrorist, when it appears to most of us that they are hiding the wanted Criminals, Terrorist and Bomb experts on their Camp?

"The death of 44 SAF New heroes, must also be the death of BBL" is what I strongly suggest does making it a title of this article. Why? Even from the start the Bangsamoro Basic Law (BBL) has received several comments and objections being BBL 'unconstitutional'. But what did the Pro-BBL do? They selected those at least ten (10) provisions of the BBL which are being said to be unconstitutional to make it acceptable for many, that's why until now they are yet to pass it to the Congress, last update says that by March of this year they should come up with the final draft. The original plan of BBL is to  finish the draft before 2013 ends so that the debate and legislation body can start with the plenary and debate about it passing it into law as the President himself has expressed his willingness and excitement to make the BBL a reality. Because, they strongly believe that this is the answer to the long time sufferings of our Brothers and Sisters in Mindanao. Which some of the scholars and I think not, because granting that it became a Law and they start operating as an Independent State, the National Government 'though still part of Bangsamoro will obviously have difficulty in imposing and in implementing rules and laws in there as these people want to govern themselves only. Another point is - - Say that BBL is established, Can we really achieve peace, when they themselves wants to rule the New State? Oh well, Since they are armed individuals, One can imagine a bloody new State perhaps. You see, Whatever amendments they did and will do will still appears to be "unconstitutional" as the basis of the creation according to some scholars and according to my research is already unconstitutional.

For instance, An article written by Rita Jimeno says that, The Philippine Constitution Association, for one, has raised many points of contention in HB 4994 despite a general agreement with the concept and objectives of the Bangsamoro political entity. Philconsa, speaking through its Chairman, Manuel M. Lazaro, said that House Bill 4994, although fashioned to be the magical legal instrument to bring about the Bangsamoro legal entity, is a clear attempt to amend the Philippine Constitution by mere legislation. Students of law understand that amending the Constitution can only be done through any of three modes, namely: a constitutional convention; a Constituent Assembly; or people’s initiative. Congress, therefore, cannot merely pass a law that will effectively amend the Constitution.

The Supreme Court also had once sited their thoughts about this matter but the Palace along with other pro-BBL politicians are so eager to make it into law. Im just wondering why His Excellency is always bypassing the SC, when he himself ousted SC Justice Corona for he think that doing so will bring light and justice to Filipinos and the entire nation. But what he's doing right now is completely opposite to what he showed us on the start. Mind you this is not the first time that his leadership bypassed the order of the Supreme Court (read other related news about it yourselves). Now, if the Government is still and is so serious about the BBL being called as highly unconstitutional, They should first follow the right process for it to be a legal one. Now if PNoy will be persistent bypassing the processes, the, this National Mourning Day will be useless and just a mere call to divert the attention of the heart-ached Filipinos.

For me what the Government can do is focused on the questions that was and that are being throwed on him to give justifiable reasons about the death of the forty four brave young men whom we now pronounce as Heroes.

And before I forget since it appears to most of the Filipinos tuning in on this issue, that the Government is so weak to defend its State against these Rebels and seemed to be afraid of offending the MILF's, His leadership is also being held accountable to answer the following questions:

- Since the Government is acknowledging the existence of Moro Islamic Liberation Front  (MILF)  and are confident of their trust. Amidst this gap 'though not advisable is/are also waiting for the result of the MILF investigation. Since we allow them to conduct there own investigation and will surely hear for their result. The next question is - Are they credible enough to conduct the investigation to make sure that the result isn't one-sided? Now, Say the results of the investigation of MILF and the Government Investigating body are different, which result do we follow? What action do we have? and which result would the President follow?

- The MNLF also has posted an alleged collaboration of MILF to the Malaysian terrorist on their Multi-Media account, granting the passing of the BBL, are we confident enough that this really will bring peace in Mindanao when there's already a report like this? Another thing is, we also have the existence of other Rebels like MNLF, BIFF, ASG, NPA and etc... Since there are other group of rebels not favored by the Government do you think there will really be peace after it? Do the government has to grant all rebel's request just for the purpose of Peace process?


I am writing this not to pretend that I know everything, that I am knowledgeable of the Law of the Land. I am writing this because I love my Country and I want to deliver my message not to waste the lives of our 44 great SAF heroes. I am writing this using the information that I have read and judging using my conscience and If I am to answer the questions above, I think the answer to most of it are NO. This is the main reason why I strongly recommend putting the BBL into junk, because First, it will and will always be Unconstitutional. Second, the MILF by way of their actions does not deserve of our trust and in fact an unworthy group - the Government should not deal with rebels and terrorist minded individuals. The murderrous and heinous death of our Heroes in Mamasapano, Maguindanao is a clear implication that these people cannot be trusted and are just deserving to eat every painful words of the aggrieved families and of every citizen of this Nation. They are thieves, murderer and a shame of every Filipino people. Therefore they do not have the rights to demand to the Government and make an appeal. If I am the president, I would and will do all I can to mark on the Philippine history the abolition of this nuisance group. They perhaps indeed deserves to be pulverized because of their inhuman traits to others. Thus, I recommend all-out war against these rebels - this is just the only way to achieve peace in the Philippines hence they are showing that they cannot be trusted.
Rest in Peace Our 44 new Heroes, your great contribution to National Security and Safety will always be remembered. We will pray for you all to the Lord, Jesus Christ. +++
