INVESTIGATIVE REPORT: 8 properties not in VP Binay's 2013 SALN



 

MANILA - At least eight properties owned by Vice President Jejomar Binay were not declared in his statement of assets, liabilities and net worth (SALN) for 2013, documents obtained by ABS-CBN News revealed.

Binay has 10 declared real property assets in his 2013 SALN but documents obtained by ABS-CBN show the Binay couple has a total of 18 properties.
 
The vice-president's 2013 SALN lists the following properties:

1. Caong St., San Antonio Makati (house & lot)
2. Caong St., San Antonio Makati (lot)
3. Alabang Hills Cupang, Muntinlupa CIty (lot)
4. Victoria Homes, Tunasan, San Pedro, Laguna (lot)
5. Shangri-la Subd., Calamba City (lot)
6. San Pascual, Laguna/ Batangas (lot)
7. Liyang Pilar, Mariveles, Bataan (lot)
8. Cabagan, Isabela (lot)
9. Balaytigue, Nasugbu, Batangas (lot)
10. Olo-olo, Lobo, Batangas (lot)

What is not included are eight more properties totaling 5,913 square meters in Pilar, Bataan and Calamba.

1. Brgy. Liyang, Pilar, Bataan (lot) T-146413- 1,206 sq. m.
2. Brgy. Liyang, Pilar, Bataan (lot) T-144458- 1,021 sq. m.
3. Brgy. Bagong Kalsada, Calamba City (lot) T-220726- 457 sq. m.
4. Brgy. Bagong Kalsada, Calamba City (lot) T-220727- 457 sq. m.
5. Brgy. Bagong Kalsada, Calamba City (lot) T-220728- 881 sq. m.
6. Brgy. Bagong Kalsada, Calamba City (lot) T-220729- 879 sq. m.
7. Brgy. Bagong Kalsada, Calamba City (lot) T-220730- 518 sq. m.
8. Brgy. Bagong Kalsada, Calamba City (lot) T-220731- 494 sq. m.
Total - 5,913 sq. m.

 
 
Records of the Pilar Municipal Assessor's Office show that in 1991, Vice President Binay had a resthouse built in a 1,000-square-meter land in Barangay Liyang in the town of Pilar, Bataan.
But until time took its toll on the once well taken care of resthouse, the said property and even the lot where it was constructed never appeared in the detailed SALNs of Vice President Binay from 1999 to 2013 when he was still mayor of Makati City until he was elected vice-president of the Philippines.
Another tax declaration acquired by ABS-CBN also shows that a nearby lot is also under the name of the vice-president.

This was also not reflected in his SALN.

The only property of VP Binay in Bataan listed in his SALN is an agricultural lot in the town of Mariveles in Barangay Liang Pilar, purchased in 1965.
ABS-CBN tried to locate the property but failed to find it.

The Mariveles Municipal Assessor's Office told the news team that there is no barangay named Liyang Pilar in Mariveles. Instead, ABS-CBN was able to trace Binay's property in Barangay Alas-asin in Mariveles.

The law requires public officials and employees to disclose and accurately declare all their properties in their SALN.

Attorney Stephen Cascolan, a private lawyer who handles several cases related to SALN, said it is important to determine if the non-inclusion of assets in the vice-president's SALN is just an oversight or if there is really an intent to hide the property.

"Ang status ng property whether tax dec[laration] lang, TCT, OCT, it's still an asset na required by law to be declared. kung hindi nagdedeclare, ang next story dyan would be merong pang ibang crimes na nacommit, kasi, why hide certain properties kung lawfully acquired naman," he said.
Also on the list of properties that are not included in his SALN are six residential lots in Barangay Bagong Kalsada in Calamba City, which were bought from Sofronio and Felisa Gutierrez in 1990 for P1.1 million.

The vice-president's only declared asset in Calamba City is a portion of land located in Shangri-la Subdivision in Barangay Sucol, which was mortgaged by Wilfredo Tiongson to VP Binay.
Meanwhile, the Binay couple also acquired another property in Balaytigue, Nasugbu, Batangas.
The property was bought in 1996 but only appeared in Binay's 2007 SALN.

"Bawat SALN kasi corresponds to a specific year so bawat SALN na nag-omit ka ng isang material declaration, isang count yun of that offense," Cascolan noted.
Even the value of some of the properties in Binay's SALN is questionable.
The market values of some of the properties stated in his SALN do not match with its corresponding tax declaration.

For example, their property in Balaytigue, Nasugbu, Batangas was valued at P162,000 in his 2007 to 2013 SALNs, meaning the property's market value did not change for the past six years.
However, its tax declaration shows that this piece of property is now pegged at P2.1 million.
The same can be seen in his San Pascual property wherein ABS-CBN learned that this piece of land was already subdivided into three separate lots.

The fair market value of the Binay property in San Pascual - at P978,397.51 - did not change in his 2007 to 2013 SALNs.
This is relatively far from the approximately P8 million total market value of his San Pascual properties stated in the corresponding tax declarations.

Based on the 2013 guidelines of the Civil Service Commission, the fair market value of the properties declared in the SALN shall refer to the amount indicated in the tax declarations of the properties involved.

Civil Service Commission Assistant Commissioner Ariel Ronquillo noted: "Pag ang inilagay mo na value is lower than what is indicated in the tax declaration, then there is dishonesty somewhere. You are not truthful in your declaration."

Two more lots in San Pascual, Batangas, valued at more than P11 million, are also listed under the vice-president's name.

ABS-CBN asked for the vice-president's side on the issue.
Vice-presidential spokesperson Joey Salgado said they cannot comment on the issue because of the pending investigation of the Ombudsman on the allegedly overpriced Makati City Hall building 2, which is also currently being probed by the Senate Blue Ribbon subcommittee.
